Terms & Conditions

1. Company Information

Gigastar.in and its parent concern, Gigastar, operate as a marketing and distribution company for computer hardware and related products.

By placing an order on our platform, the customer agrees to be bound by the terms and conditions stated herein.

2. GST & Invoicing

  • We issue valid GST invoices for all products sold.

  • If the buyer wishes to include a GST number on the invoice, the GST details must be provided at the time of order placement.

  • Buyers must ensure that their GST registration under the GST Act, 2017 is valid on the date of purchase.

  • GST certificate (all relevant pages) may be required for verification.

3. Shipping & Delivery Responsibility

  • Our responsibility for the goods ends once the order leaves our warehouse.

  • Once an order is shipped or an AWB (Air Waybill) number is generated, cancellation of shipping charges is not possible.

4. Open Box Delivery Policy

Orders delivered under Open Box Delivery are inspected by the customer in the presence of the delivery partner.

Once the product is verified and accepted, the order is deemed successfully delivered, and no return or refund shall be applicable for such orders.

5. Order Cancellation, Modification & Refund Deductions

  • Cancellation before shipping: 2% convenience fee

  • Cancellation after shipping: 5% cancellation fee

  • Order modification after shipping: 3% fee

  • No charges apply for modifications before shipping

These charges, along with applicable logistics and payment gateway fees, shall be adjusted from the refund amount, if applicable.

For orders paid using Credit Card or EMI, a 5% deduction from the total order value shall apply in case of buyer-initiated cancellations.

6. Exception-Based Returns

Returns may be accepted only as a goodwill exception and strictly at the discretion of Gigastar.

If a return is approved as an exception:

  • Forward shipping

  • Return shipping

  • Payment gateway / convenience charges
    shall be deducted from the refund amount.

Proceeding with such a return implies customer’s consent to these deductions.

7. Product Nature & Usage

  • Products sold are computer spares and components and do not constitute a complete system unless explicitly mentioned as a “New PC System”.

  • Any special usage or abnormal operating environment must be informed at the time of purchase; failure to do so may result in warranty voidance.

  • Ignorance of terms and conditions shall not absolve the customer of responsibility.

8. Gaming Chairs Policy

For gaming chairs:

  • Only part replacements are applicable for defects or damage.

  • Refunds are not applicable under any circumstances.

9. DOA (Dead on Arrival) Policy

  • All accessories, manuals, and packaging must be intact.

  • Incomplete returns may be rejected and treated as RMA instead of DOA.

10. Warranty & RMA Terms

  • All products are covered under Carry-In Warranty unless specified otherwise.

  • Shipping charges for RMA outside the policy window shall be borne by the customer.

  • On-site warranty is subject to brand service availability; otherwise, it defaults to Carry-In service.

  • Warranty does not cover physical damage, mishandling, electrical issues, or tampering.

Warranty becomes void if:

  • Warranty stickers are damaged or removed

  • Pins are burnt/broken

  • Components are missing or tampered

  • Improper installation or handling is evident

11. Manufacturer Warranty

“Manufacturer Warranty” or “Direct Warranty” implies warranty obligations rest with the manufacturer/distributor.

Gigastar bears no legal or financial liability for such warranties but may assist customers in the claim process.

12. Payments & Service Conditions

  • Warranty or service support shall be provided only after full payment clearance.

  • Cash payments above ₹50,000 are not accepted.

  • RMA and warranty services are subject to brand policies and timelines.

13. Order Cancellation Rights

Gigastar reserves the right to cancel any order due to:

  • Pricing errors

  • Stock unavailability

  • Technical or operational issues

14. Intellectual Property & Website Use

All content on the website is protected by applicable intellectual property laws. Unauthorized use or commercial exploitation is prohibited.

Content is provided on an “as-is” basis without warranties of any kind.

15. Limitation of Liability

Gigastar shall not be liable for:

  • Transit damage (unless insured)

  • Manufacturer delays

  • Indirect or consequential losses

Service-related disputes must be addressed directly with the manufacturer or distributor.

16. Jurisdiction

All disputes arising from transactions shall be subject to exclusive jurisdiction of courts in Kolkata, West Bengal.
